Terms and Conditions
1. Introduction
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “Sender,” or “Customer”) and Maneuver It Inc. (“Maneuver”), governing the use of Maneuver’s shipping facilitation services within Canada. Maneuver It Inc. shall hereinafter be referred to as “Maneuver” for the purposes of these Terms. By accessing or using Maneuver’s services, you acknowledge and accept these Terms in full. If you do not agree, you must immediately cease using the services. These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “Sender,” or “Customer”) and Maneuver, governing the use of Maneuver’s shipping facilitation services within Canada. By accessing or using Maneuver’s services, you acknowledge and accept these Terms in full. If you do not agree, you must immediately cease using the services.
2. Independent Contractor Status
Maneuver does not own, lease, operate, or manage any transportation vehicles. All delivery services are executed by independent third-party contractors (“Carriers”) who are neither employees, agents, nor representatives of Maneuver. The Customer expressly acknowledges and agrees that Maneuver assumes no liability for any acts, omissions, misconduct, negligence, or errors of Carriers, nor does Maneuver supervise, direct, or control their work.
3. Scope of Services and Limitations
Maneuver provides a shipping facilitation service and does not guarantee or warrant delivery times, conditions, or outcomes. Any estimated timelines provided are for reference only and do not constitute a contractual obligation. Maneuver retains the absolute and unilateral right to refuse, suspend, or terminate service at its sole discretion, including, but not limited to, situations involving security risks, regulatory non-compliance, fraudulent activity, or improper packaging. Shipments are strictly limited to destinations within Canada. Cross-border transport or international shipments are prohibited. Maneuver shall not be liable for any loss, damage, or delay arising from circumstances beyond its control, including but not limited to weather conditions, traffic disruptions, labor strikes, governmental actions, acts of war, or acts of third parties.
4. Liability and Cargo Coverage
Maneuver’s maximum liability for any single shipment shall be strictly limited to $100 CAD, irrespective of the actual or declared value of the goods transported. Under no circumstances shall Maneuver be liable for consequential, incidental, or punitive damages. The Customer assumes all risks and liabilities exceeding the $100 CAD coverage. Additional insurance coverage, if desired, must be arranged independently by the Customer. Maneuver expressly disclaims liability for loss or damage arising from, but not limited to improper packaging, inherent defects in shipped goods, third-party mishandling, force majeure events, or failure to comply with applicable laws.
5. Prohibited Items and Compliance Obligations
The following items are strictly prohibited from being transported using Maneuver’s services:People: Please use Rides for personal transport. People cannot be riders during package deliveries. You cannot use this service to deliver live animals.Illegal items: Anything that’s illegal to possess, sell, or transfer is not allowed.Weapons and ammunition: Including firearms, parts of weapons, and all types of ammunition.Alcohol and cannabis: All alcohol and cannabis products are prohibitedHighly perishable food or beverages (e.g., raw meat or dairy products).Pharmaceuticals: Prescription drugs, medications, vitamins, and supplements cannot be sent unless the pickup or drop-off location is a pharmacy or healthcare facility.Financial instruments: Don’t send money, gift cards, or lottery tickets.Recreational drugs and paraphernalia: This includes any tobacco products.Hazardous materials: Explosives, flammable, nuclear, or infectious substances, and anything identified as dangerous under relevant laws and regulations.Stolen goods: Sending stolen items is not allowed.Fragile items: Items that are easily broken are prohibited due to the risk of damage.Offensive materials: Sexual aids or obscene/pornographic items cannot be sent.Regulated species and animal products: No parts, blood, fluids, or live animals are allowed.
• Unauthorized items: If you don’t have permission to send it, don’t.
6. Packaging and Sender Responsibilities
The Customer is solely responsible for ensuring that shipments are adequately and securely packaged to prevent damage, leakage, or deterioration during transit. Shipments must comply with all applicable labeling, documentation, and regulatory requirements. Fragile, valuable, or high-risk items must be properly marked, and additional protective measures should be undertaken at the Customer’s expense. Maneuver shall not be held responsible for damage resulting from inadequate or improper packaging.
7. Claims and Dispute Resolution
Any claims for loss, damage, or non-delivery must be formally submitted in writing within five (5) calendar days of the scheduled delivery date. Claims received beyond this period shall be deemed null and void. Maneuver reserves the exclusive right to investigate claims and determine eligibility for compensation, which shall in no event exceed the $100 CAD liability cap. Disputes arising from these Terms shall be subject to mandatory binding arbitration under the applicable arbitration laws of Canada. The Customer waives any right to initiate class action lawsuits, jury trials, or any other judicial proceeding against Maneuver.
8. Disclaimer of Warranties
Maneuver provides services on an “as is” and “as available” basis, without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted service. Maneuver expressly disclaims liability for any service interruptions, system failures, or errors beyond its reasonable control.
9. Amendments and Termination
Maneuver reserves the right to modify, amend, or terminate these Terms at any time, at its sole discretion, without prior notice. Continued use of Maneuver’s services constitutes unconditional acceptance of the modified Terms.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to conflicts of law principles. Any legal disputes shall be subject to the exclusive jurisdiction of the courts of Canada.
11. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law. By using Maneuver’s services, you affirm that you have read, understood, and agreed to be bound by these Terms in their entirety.
